(El Cajon, Calif.) —Investigators from the El Cajon Police Department’s Traffic Unit made an arrest today in connection to a fatal collision that occurred on January 3, 2010. El Cajon resident Richard Daus was taken into custody at his home, after police investigators obtained an arrest warrant for him in connection to the January fatal collision.

In January, Randy Smith was sitting at a table at the Carl’s Jr. Restaurant on Second Street when Daus drove his vehicle through the building. Smith was struck by the vehicle and pronounced dead at the scene. Daus also suffered injuries and was transported to the hospital for treatment.

El Cajon Police Investigators have been actively conducting an investigation into the cause of the collision. As a result, investigators determined that Daus was driving while intoxicated at the time of the collision. The case was submitted to the San Diego County District Attorney’s Office and charges were filed against Daus for Felony Vehicular Manslaughter and Felony Driving Under the Influence of Alcohol. Police Investigators obtained an arrest warrant for Daus and arrested him at his home in El Cajon. Daus was cooperative with investigators and booked into county jail to await arraignment.
